Legalities Of Building Your Own Gun?
What Federal laws, if any, apply if you manufacturer your own firearm? I mean from boring your own barrel to milling your own AR-15 Lower Receiver from a stock piece of Aluminum. Do you have to do anything with the BATFE?
From what I've heard on the grape vine, its only a recommendation that you place a serial number on your weapon, but overall, there no restrictions on the production of firearms you DO NOT plan on selling.
Is this true?
From ATF: "Individuals manufacturing sporting-type firearms for their own use need not hold Federal Firearms Licenses (FFLs). However, we suggest that the manufacturer at least identify the firearm with a serial number as a safeguard in the event that the firearm is lost or stolen. Also, the firearm should be identified as required in 27 CFR 478.92 if it is sold or otherwise lawfully transferred in the future."
Yes you can build your own firearm, no you are not required to put any markings on it but it is a good idea to do so. Yes you may sell it, however if you are building guns specifically to sell or give to other people you must be a licensed manufacturer. If you build a gun for youself and use it and later decide to sell it or give it away then you are not a manufacturer and do not need a license.
A note to Fatefinger's answer. A machinge gun can only be manufatured by a licensed manufacturer with an SOT. It can only be sold to another licensed manufacturer, a licensed machine gun dealer, or a government agency. If the SOT does not renew his license, any machine must be transerred or destroyed. An individual can make any other NFA weapon (silencer, Short Barrel Rifle, Short Barrel Shotgun, AOW) by submitting an ATF Form 1 and receiveing approval before making the item. If you live in a state that allow the particular weapon and you are elligable to possess a firearm, ATF will approve the request. They only deny them if it would be illegal for you to possess the weapon you want to make.
